A PLUS TILE INSTALLATION LLC – TERMS OF USE

These Terms of Use (“Terms”) govern your access to and use of the website aplustileinstallation.com (the “Site”), which is operated by A PLUS TILE INSTALLATION LLC (“A+ Tile Installation,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site.

1. Eligibility

You may use the Site only if you are at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a binding contract. By using the Site, you represent and warrant that you meet these requirements.

2. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You must not:

Use the Site in any way that violates applicable laws or regulations;
Submit false, inaccurate, or misleading information through any form;
Attempt to gain unauthorized access to any part of the Site, our systems, or networks;
Introduce viruses, malware, or other harmful code;
Interfere with or disrupt the operation of the Site or any servers or networks used to make the Site available.

3. Information, quotes, and design concepts

When you submit information through the Site, we may respond with general information, quotes, estimates, or preliminary assessments (“Estimates”), and may provide manually created or AI-generated design concepts (“Design Concepts”) for your space.

Estimates and Design Concepts are provided for planning and illustration only. They:

Do not constitute a binding agreement or final price;
May differ from the final installed materials, colors, or layout;
Do not replace the need for on-site measurements or inspections.

Any actual installation or construction work will be governed by a separate written agreement between you and A+ Tile Installation.

4. User content

The Site may allow you to submit information, text, photos, or other materials (“User Content”) through forms or file uploads.

You represent and warrant that:

You have all necessary rights to submit the User Content;
Your User Content does not infringe or violate any third-party rights;
Your User Content does not contain unlawful, abusive, or otherwise inappropriate material.

By submitting User Content, you grant A+ Tile Installation a non-exclusive, royalty-free license to use, reproduce, and create derivative works from such User Content solely for the purposes of responding to your inquiries, preparing Estimates, generating Design Concepts, and providing services to you.

5. Intellectual property

The Site and its content, including text, graphics, logos, photos, layouts, Design Concepts, and other materials (collectively, “Content”), are owned by A+ Tile Installation or used with permission and are protected by intellectual property laws.

You may view and print Content for your personal, non-commercial use in connection with evaluating or using our services. You must not copy, reproduce, distribute, modify, or publicly display any Content without our prior written consent, except as permitted by law.

6. Third-party services and links

The Site may include links to third-party websites or may rely on third-party tools and services (such as analytics, hosting, or AI tools). These third parties are not controlled by A+ Tile Installation, and we are not responsible for their content, policies, or practices.

Your use of any third-party site or service is at your own risk and may be subject to separate terms and conditions or privacy policies.

7. Privacy

Our collection and use of personal information through the Site are described in our Privacy Policy. By using the Site, you acknowledge that you have read and understand our Privacy Policy.

8. Disclaimer of warranties

The Site and all Content, Estimates, and Design Concepts made available through the Site are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, A+ Tile Installation disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

The Site will be uninterrupted, secure, or free of errors or defects;
Any Content, Estimate, or Design Concept will be accurate, complete, or current;
Colors, textures, or patterns displayed on digital screens will exactly match actual materials.

9. Limitation of liability

To the fullest extent permitted by law, A+ Tile Installation, its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Site or any Content, Estimates, or Design Concepts.

In no event will our total liability to you for all claims arising out of or related to the Site exceed one hundred dollars (USD $100), or the amount you paid us through the Site for the specific service giving rise to the claim, whichever is greater. Some jurisdictions do not allow certain limitations, so these limits may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless A+ Tile Installation and its owners, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of the Site;
Your violation of these Terms;
Your violation of any rights of another person or entity;
Your User Content.

11. Changes to the Site and these Terms

We may update, modify, or discontinue any part of the Site at any time, with or without notice. We may also update these Terms from time to time. When we do, we will revise the “Effective date” at the top of this page.

Your continued use of the Site after the updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Site.

12. Governing law and jurisdiction

These Terms and any dispute arising out of or relating to your use of the Site will be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in or serving Kane County or the surrounding area in Illinois, and you consent to the personal jurisdiction of those courts.
